General terms and conditions for bookings with Discover Weimar - Andrea Otto. Courtesy translation - only the German version is legally binding.

§ 1 Scope and contracting party

(1) These General Terms and Conditions apply to all city tours, themed tours and other services provided by Andrea Otto, Discover Weimar, Karlstr. 9, 99423 Weimar, Germany (hereinafter “the provider”), whether booked via the website or directly.

(2) Deviating terms of the customer only apply if the provider expressly agrees to them in text form.

§ 2 Conclusion of contract

(1) The presentation of tours on the website does not constitute a binding offer.

(2) By submitting the request form or a request by email or phone, the customer makes an offer to conclude a contract. The contract is only concluded once the provider confirms the booking by email or in writing.

(3) Where the website offers direct booking via an online calendar, the contract is concluded when the booking is completed. A confirmation is then sent automatically by email.

(4) These terms are expressly referred to before a request or booking is submitted. They are available on the website at any time and can be saved and printed.

§ 3 Services

(1) Scope, duration, meeting point and route are set out in the tour description on the website or in the booking confirmation. Minor changes to the route, for example due to construction work, events or closures, remain reserved as long as the character of the tour is preserved.

(2) All bookings are private, exclusive bookings for the respective group, family, school class or company at a fixed price. There is no minimum number of participants. The maximum number of participants stated in the tour description is binding.

(3) Admission fees for museums, buildings or other facilities are not included in the price unless expressly stated otherwise in the tour description.

§ 4 Prices and payment

(1) The prices stated on the website or in the offer at the time of booking apply. All prices are final prices. In accordance with § 19 UStG (German VAT Act), no VAT is charged.

(2) The price is due on site on the day of the tour, in cash or by card. No advance payment is taken at booking.

(3) School classes, schools and corporate customers may pay by invoice. Invoices are payable within 14 days of the invoice date without deduction.

§ 5 Cancellation and rescheduling by the customer

(1) Cancellation or rescheduling is free of charge up to 24 hours before the agreed start of the tour. It can be made informally by email or phone; the time of receipt by the provider is decisive.

(2) For later cancellations, or if the tour is not attended without prior cancellation, the agreed price is payable in full (100 %).

(3) The customer is expressly entitled to prove that the provider has suffered no loss or a significantly lower loss. In that case only the lower amount is payable.

§ 6 Cancellation or postponement by the provider

(1) Tours generally take place in all weather. In objectively dangerous weather (e.g. an official severe weather warning, thunderstorms) or for other compelling reasons, such as illness of the provider, the provider may cancel the tour. She will inform the customer without delay.

(2) If the provider is unable to lead the tour at short notice, a qualified colleague from the Verein der Stadtführer Weimars e.V. (Weimar city guides association) may take over the tour by arrangement.

(3) If the tour does not take place, the customer may choose between a free alternative date and withdrawal from the contract. In the case of withdrawal, no payment is owed; any amounts already paid or invoiced will be refunded or cancelled in full. This applies irrespective of the deadline in § 5.

§ 7 No right of withdrawal

The tours offered are services related to leisure activities for which a specific date is provided. Under § 312g (2) no. 9 BGB (German Civil Code), there is no statutory right of withdrawal for such contracts. The cancellation rules in § 5 apply instead.

§ 8 Participants’ obligations, duty of supervision

(1) Participants are asked to arrive at the agreed meeting point on time and to wear weather-appropriate clothing and sturdy shoes. The provider’s safety instructions, especially in road traffic, must be followed.

(2) In the event of late arrival, the tour ends at the agreed time; there is no entitlement to an extension or a price reduction. If nobody arrives within 30 minutes of the agreed start and the customer has not been in touch, the tour is deemed not attended (§ 5 (2)).

(3) On tours with children and young people, in particular school classes and families, the duty of supervision remains with the accompanying teachers, parents or other supervisors throughout the tour. The provider does not assume any duty of supervision.

§ 9 Liability

(1) The provider is liable without limitation for intent and gross negligence and for injury to life, body or health.

(2) In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely), liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability for slightly negligent breaches of duty is excluded.

(4) The provider accepts no liability for items brought along by participants, unless a case under paragraphs 1 or 2 applies.

§ 10 Data protection

Information on the processing of personal data can be found in the privacy policy on this website.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

(2) The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

(3) Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
